1. Agreement to Terms

2. Emergency Services
We provide 24/7 emergency tree removal, storm damage cleanup, and related services in Montgomery County, TN and surrounding areas. Response times may vary based on weather conditions, road safety, and existing emergency volume during severe storm events (such as EF-rated tornadoes). We reserve the right to prioritize calls based on immediate threat to life and structural integrity.
3. Communications and SMS Consent
By providing your phone number through our contact forms or by calling our emergency line, you consent to receive calls and text messages (SMS) from Clarksville Emergency Tree Pros regarding your service request, dispatch updates, and account information. Standard message and data rates may apply. You may opt out of SMS communications at any time by replying "STOP".
4. Insurance Direct Billing & Payment
As a courtesy, we offer direct billing to homeowner's insurance providers for covered perils. However, the property owner remains ultimately responsible for the full cost of services rendered if the insurance claim is denied or only partially covered. For services not covered by insurance, payment is due upon completion of the work unless prior arrangements have been made.
5. Property Access & Authorization
By requesting our services, you confirm that you are the property owner or have the legal authority to authorize tree removal and property access. You grant our crews and equipment (including heavy machinery like cranes) permission to enter your property to perform the requested services. You are responsible for identifying and communicating any underground utilities, septic systems, or sprinkler lines prior to work commencement.
6. Permits and Exemptions
While Clarksville provides emergency exemptions for immediate storm damage hazards, the property owner is responsible for ensuring compliance with local ordinances for non-emergency tree removals. We can assist with the permit process, but the ultimate responsibility and any associated fees rest with the property owner.
7. Limitation of Liability
We are fully licensed and insured. Our liability is limited to the direct scope of the tree removal work. In no event shall Clarksville Emergency Tree Pros be liable for any indirect, consequential, or incidental damages arising out of the performance of our services. We are not responsible for pre-existing damage to structures, driveways, or underground utilities not properly marked prior to our arrival.
8. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions. Any legal action or proceeding related to our services shall be brought exclusively in a state or federal court of competent jurisdiction sitting in Montgomery County, Tennessee.
